WebWave Digital AI provides AI-powered receptionist, lead capture, scheduling, and related services. Service details, pricing, and features are outlined on our website or in your service agreement.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using our Services you represent and warrant that you meet these requirements.

3. Account, Credentials & Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Fees, Billing & Refunds

Fees, billing cycles, and payment terms are specified in your service agreement or on our pricing page. Unless otherwise stated, fees are non-refundable except as required by law or expressly provided in your contract.

5. Use Restrictions & Compliance

You agree not to use the Services for unlawful purposes. You are responsible for ensuring that your use of our Services complies with applicable laws, including data protection and telemarketing rules.

6. Data, Leads & Subleasing (Sublease Compliance)

Ownership: Unless otherwise agreed, clients own the lead data collected through the Services about their customers.

Subleasing / Reselling: If you sublease, resell, or white-label our Services to third parties (e.g., offering our receptionist services under your brand), you must:

  • Obtain written consent from WebWave Digital AI prior to reselling or subleasing.
  • Maintain accurate records of end customers and the data flows associated with them.
  • Ensure end customers receive clear privacy notices and agree to data processing terms equivalent to those in our Privacy Policy.
  • Not represent the Services as being owned by you; disclosures must clarify that WebWave Digital AI provides the underlying service.
  • Be fully responsible for compliance with local laws, billing, refunds, and customer support to end customers.

Violation of sublease/resell requirements may result in termination of service and potential liability for damages.

7. Intellectual Property

All intellectual property rights in our Services and website are owned by WebWave Digital AI or our licensors. You may not copy, modify, or distribute our software or content without permission.

8. Confidentiality

Each party agrees to protect confidential information disclosed by the other and to use it only as permitted by these Terms.

9. Disclaimer of Warranties & Limitation of Liability

Services are provided “as is.” To the fullest extent permitted by law, WebWave Digital AI disclaims all warranties. Our liability is limited to direct damages up to the amount of fees paid in the preceding 12 months.

10. Termination

Either party may terminate according to the terms outlined in the service agreement. We reserve the right to suspend or terminate access for violations of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws specified in your service agreement. Disputes may be resolved via arbitration if agreed in writing.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to you and posted on our website.
